Information on the processing of personal data pursuant to Art. 13 DS-GVO

With the following information, we would like to give you an overview of the processing of your personal data by us and your rights under data protection law.
Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behaviour.

The responsible party pursuant to Art. 4 (7) of the EU General Data Protection Regulation (DSGVO) is: SWISS TECHNOLOGY ENTERPRISE GmbH represented by its managing director: Heidi Wider, Kirchrain 27, CH-9422 Staad SG.

If we use commissioned service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. In doing so, we will also state the defined criteria for the storage period.

1. Your rights

(1) You have the following rights with regard to the personal data concerning you: - right to information, - right to correction or deletion, - right to restriction of processing, - right to object to processing, - right to data portability.

(2) You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.

2. Collection of personal data when visiting our website

(1) In the case of merely informative use of the website, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f DSGVO):

- IP address
- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code

The collection of this data does not take place constantly, but only if this is necessary for technical or security reasons.

(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive in relation to the browser you are using and which provide the party setting the cookie (in this case, us) with certain information. Cookies cannot execute programmes or transfer viruses to your computer. They serve to make the Internet offer as a whole more user-friendly and effective.

3. Use of cookies

b) Transient cookies are automatically deleted when you close the browser. These include, in particular, session cookies. e) The Flash cookies used are not collected by your browser, but by your Flash plug-in. Furthermore, we use HTML5 storage objects that are stored on your end device. These objects store the required data independently of the browser you are using and have no automatic expiry date. If you do not want Flash cookies to be processed, you must install an appropriate add-on, e.g. the Adobe Flash Killer Cookie for Google Chrome. You can prevent the use of HTML5 storage objects by using private mode in your browser. We also recommend that you regularly delete your cookies and browser history manually.

3.1 Data transfer

Within SWISS TE GmbH, only those employees receive access to your data who need it to process the training measures or to provide the service. Contractors employed by us may also have access to personal data on a case-by-case basis. They are contractually obliged to comply with the same data protection standards, may only process your personal data to the same extent and for the same purposes as we do and are subject to our instructions. These are companies in the IT services and telecommunications categories or service providers.

A transfer of data to recipients outside of the jointly responsible parties takes place due to legal requirements, such as the transfer of invoice data to the tax advisor in the context of the preparation of the accounting or to the responsible tax office in the context of the submission of the annual financial statements.

As a rule, data is not transferred to third countries (countries outside the European Economic Area - EEA). Should this nevertheless be the case, the data transfer is regulated on the basis of an adequacy decision, consent, binding corporate rules or concluded EU standard data protection clauses.
4 Further functions and offers of our website

(1) In addition to the purely informational use of our website, we offer various services that you can use if you are interested. For this purpose, you usually have to provide further personal data which we use to provide the respective service and for which the aforementioned data processing principles apply.

(2) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly monitored.

(3) Furthermore, we may pass on your personal data to third parties if we offer promotions, competitions, contracts or similar services together with partners. You will receive more detailed information on this when you provide your personal data or below in the description of the offer.

4a. E-mail contact and use of the contact form and registration form

(1) To contact us, you can use the contact form or the e-mail address provided. In doing so, personal data such as name, e-mail address or telephone number are processed. We process the data provided here by the user exclusively for the purpose of contacting them and processing their related request.

(2) The legal basis for the processing of this data is our legitimate interest in contacting you and processing your request in accordance with Section 6 (1) of the German Data Protection Act (DSGVO).

(3) If the enquiry via the contact form or e-mail leads to the conclusion of a contract, the processing of the data provided is necessary for the performance of a contract.

(4) The data provided will be processed until they are no longer required to achieve the purpose. The purpose is no longer achieved when the user's request has been conclusively clarified and the contact has thus ended.

(5) Users have the option to object to data processing at any time. In this case, the data provided for contacting will be deleted and no longer used. The objection is to be sent to the contact addresses mentioned under § 1 or § 2.

(6) We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are statutory retention obligations. German commercial law provides for 6 years for this, if it is not a matter of invoices or credit notes. We generally retain tax law documents for 10 years.

4b. Newsletter

(1) The subscription to the newsletter is free of charge, does not oblige you to anything and can be revoked at any time.

(2) The purpose of sending the newsletter is to provide event-related information about news and events concerning SWISS TE GmbH.

(3) An e-mail address is required to register for the newsletter. The legal basis for the processing is Art. 6 para. 1 sentence 1 letter a DS-GVO.

5. objection or revocation against the processing of your data

(1) If you have given your consent to the processing of your data, you may revoke it at any time. Such revocation will affect the permissibility of processing your personal data after you have expressed it to us.

(2) Where we base the processing of your personal data on the balance of interests, you may object to the processing. This is the case if the processing is not necessary, in particular, for the fulfilment of a contract with you, which is shown by us in each case in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will review the situation and either discontinue or adapt the data processing or show you our compelling legitimate grounds on the basis of which we will continue the processing.

(3) Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time. 5.1 Deletion

(1) Data of interested parties
If an interested party does not contact Golfakademie for longer than 2 years, their personal data will be deleted.

(2) Data of customers and business partners Personal data will be deleted after expiry of the legal and contractual retention periods in accordance with § 257 of the German Commercial Code and § 147 of the German Fiscal Code. If personal data is not subject to any retention periods, it will be deleted as soon as the aforementioned purposes no longer apply.

6. SSL encryption

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as enquiries that you send to us as site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties.

7. Newsletter

(1) With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers. The advertised goods and services are named in the declaration of consent.

(2) We use the so-called double opt-in procedure to subscribe to our newsletter. This means that after your registration we will send you an e-mail to the e-mail address you have provided, in which we ask you to confirm that you wish to receive the newsletter. As long as you do not confirm your registration, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses and the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data.

(3) Only your e-mail address is required for sending the newsletter. The provision of further, separately marked data is voluntary and will be used to address you personally. After your confirmation, we store your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 p. 1 lit. a DS-GVO.

(4) You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the revocation by clicking on the link provided in every newsletter email, by email to info@golf-muc or by sending a message to the contact details provided in the imprint.

8. Use of Google Analytics

(1) This website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymisation is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area.
Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.

(2) The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

(3) You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: tools.google.com/dlpage/gaoptout;

(4) This website uses Google Analytics with the extension "_anonymizeIp()". This means that IP addresses are processed in a shortened form, thus excluding the possibility of personal references. If the data collected about you is related to a person, this is immediately excluded and the personal data is deleted immediately.

(5) We use Google Analytics to analyse and regularly improve the use of our website. The statistics obtained enable us to improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, www.privacyshield.gov/EU-US-Framework. 9. Integration of Twitter

Insofar as tweets are integrated into reports and information on our website and you call up this article, you transmit to Twitter (Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA) that you have clicked on an article. In the process, personal data such as the IP address of your computer and your visitor behaviour (see point 3 above) are transmitted to Twitter's servers in the USA. By activating the plug-in, your personal data is transmitted to Twitter and stored in the USA. The data transfer takes place regardless of whether you have an account with Twitter and are logged in there. If you are logged in to Twitter, the data we collect is directly assigned to your Twitter account. If you click on the article, Twitter also saves this information in your user account and may share it publicly with your contacts. We therefore recommend that you log out regularly after using Twitter, as this is the only way to avoid being associated with your Twitter profile.

10. YouTube

We have integrated YouTube videos into our internet offer, which are stored on http://www.YouTube.com and can be played directly from our website. These are integrated in "extended data protection mode". This means that no data about you as a user is transmitted to YouTube if you do not play the videos. Data is only transmitted to YouTube when you play the videos. We have no influence on this data transfer ourselves. By visiting the website, YouTube receives the information that you have accessed the corresponding sub-page of our website. In addition, the above-mentioned data is transmitted. This occurs regardless of whether YouTube provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google or YouTube, your data will be directly assigned to your account. If you do not want your data to be associated with your YouTube profile, you must log out before activating the button. YouTube stores your data as a usage profile and uses it for the purposes of advertising, market research and/or designing its website in line with requirements. This service is provided by Instagram Inc. (1601 Willow Road, Menlo Park, CA, 94025, USA). Your data is transferred to Instagram in the USA. If you are logged into your Instagram account, you can link content, in particular images, from https://www.instagram.com/swiss-te/ to your Instagram profile by clicking the button. Instagram can thereby connect the visit to our site with your user account and log it. We have no influence on how your personal data is handled on Instagram.
